Profile

Patrick Hehenberger

Dipl.-Ing. (TUM Technical University of Munich) MSc Constr.Law & Disp.Res (King’s College London) FCIArb (CIArb London)

Patrick Hehenberger is resolutely independent and non-partisan, and he provides his services in person, and with dedication to the mission.

Mr Hehenberger’s dual qualification is key to the effective avoidance and resolution of disputes in Construction and related industries :

  • He is a German Diplomingenieur of Technische Universität München.
  • He holds a Master’s degree in Construction Law & Dispute Resolution from King’s College London.

After university and further scientific research in 1996 at Ecole Nationale des Ponts et Chaussées, Paris, he joined one of the world’s largest contractors at their headquarters in Paris, where he spent many years working on a wide variety of travaux publics - international major projects. Since the first days in his professional career in fact, Patrick has worked equally in French and English and German.

He has later served Swiss and German tunnelling contractors, and a Geneva-based, internationally operating engineering consultancy, before moving into private construction disputes resolution practice in 2008.

Patrick Hehenberger has more than 30 years of experience, both in-house and on-site, in engineering, tendering, costing, construction operations, operative and financial controlling, contracts and claims management, expertise and dispute resolution: his interdisciplinary, cross-border, intercultural assignments and mandates include bridges and highways of size, special foundations, cement and hydropower plants, as well as tunnels for rail, road, waste, sewage and electrons; hotel & residential, food processing, HVAC & FF; power generation and infrastructure (including Gas and CHP generation, substations and HVA grids, and a North Sea windfarm HVDC converter platform of size + subsea cables), in Europe, Asia and Africa. Patrick was heavily involved in the development of Germany’s first-ever BOT infrastructure, a major immersed tunnel road link in a demanding Concessionaire-Contractor-Authority framework. He has served on four major (1x CERN, 2x NRLA/NEAT, 1x urban utility) tunnelling construction sites in Switzerland, and was the Site Manager for the last of them, reporting to a German Contractor.

Patrick acts as Expert in arbitrations (both tribunal-appointed and party-appointed, in English and French), and he sits on Dispute Boards (standing or adjudicating ad hoc, in either language). He is Sole Member of a French-speaking DB relating to Energy.

Patrick had published and given lectures on some of the above, and more recently so on Dispute Resolution (including on Adjudication, in International Construction Law Review ICLR).

Patrick is the inaugural winner of the European Society of Construction Law ESCL Master Thesis Prize.

He has become a Chartered Engineer through the Institution of Civil Engineers ICE, and he is a Past ICE Representative in Switzerland.

Patrick has gained FCIArb Fellowship of the Chartered Institute of Arbitrators.

He holds Membership with ASA, SCL and DIS, and is listed a Professional Dispute Board Practitioner at the Dispute Resolution Board Foundation DRBF.
